With few surprises, techies were underwhelmed with Apple’s iPad 2 announcement, but I’m confident that consumers will be thrilled with the product. Apple already had a massive lead in the consumer tablet market it created, and these “underwhelming” upgrades should keep the company comfortably ahead. Apple has given competitors an opening by sticking to 3G, and it did not further pressure them with a lower entry price point or higher-resolution display. However, Apple has three critical advantages.




1. Brand: When consumers are thinking about tablets, they say they are buying an “iPad,” not a “tablet.” The iPad was already the category and volume leader, and the iPad 2 builds on that. In this respect, Apple actually benefits from the crowd of new tablets hitting the market. If there were only one or two strong competitors, consumers would be able to weigh the pros and cons of each offering, but with dozens and dozens of options hitting the market over the next few months, decision paralysis can set in and many consumers will throw up their hands and make the “safe” choice: the iPad.


2. iTunes: The iPad is still the only tablet on the market with a huge digital marketplace for movies, TV shows, and music. Some competitors are taking steps in this direction (e.g., Samsung’s Hub), but iTunes remains a significant competitive advantage.


3. App Store: If all you want to do is browse the Web and check e-mail, any tablet will probably suffice. However, Apple has an enormous lead in purpose-built apps. The Android ecosystem is strong and app availability should improve significantly over time, but the iPad 2 is considerably more versatile than any of its competitors right now, and it appears unlikely to lose its lead any time in the near future.


So if you are competing with Apple, what should you do? Rather than copying Apple’s products, copy its old advertising tag line and Think Different.


Apple’s brand is focused on creative types (or those who aspire to be), which is why it spends so much effort creating things like GarageBand. Competitors should target IT managers, knowledge workers, outdoorsy people, or some other group and build software and hardware combinations better suited to those use cases. Of course, this will take imagination and the ability to tie hardware, software, and services together to build unique experiences. There are some companies thinking outside the box (HTC and RIM have clearly differentiated products on their roadmaps), but for the vendors who are trying to out-Apple Apple… good luck. Here are some pointers, you’re going to need them:


• Based on Apple’s financials, it is clear that the iPad with WiFi is Apple’s volume product and 3G versions are merely gravy. Why is the competition only targeting the gravy?


• iTunes remains a significant competitive advantage for Apple – I cannot easily explain to novices how to get a movie onto the XOOM. Rivals need an “iTunes” of their own, but having one just achieves parity with Apple, so partnering is an acceptable approach. However, half measures are not enough; digital media stores must include movies (including rentals) and TV shows and music. If multiple partners are used, the tablet vendor still needs to provide a common interface and single account/billing relationship.


• Nintendo has a significant base of game developers targeting the 3DS; if you cannot muster equivalent resources (for gaming, media playback, or some other use), adding 3D to your tablet is just a gimmick.


• Apple’s rivals can compete on 4G, higher-resolution displays, or a lower price. Even speed is a potential differentiator from a technical perspective; NVIDIA has quad-core processors sampling this month, so rivals could build even faster tablets for this holiday season. However, I must still caution vendors that all of these factors are irrelevant if consumers do not want your product.









I read an interesting article this morning that suggested Apple would change its mind and put Adobe’s Flash technology on its iOS devices within a year. I don’t think that’s going to happen.


In an open letter to users, Apple CEO Steve Jobs gave several reasons why he didn’t want Flash on the iPad, iPhone or iPod touch. They are: Flash isn’t open; the full web; reliability, security and performance; battery life; and touch.


Adobe began shipping Flash Player 10.1 for Mobile last June, but even Laptop magazine admitted that “Steve Jobs was right,” and that “Adobe’s offering seems like it’s too little, too late.” Granted, that report was from six months ago, but it still doesn’t bode well for the technology.


There is no doubt that Adobe is making advances with Flash on mobile devices, but I don’t believe future changes will be enough to get Apple to adopt the technology.


Jobs has been very clear that Apple supports HTML5, an open technology that is controlled by a standards committee, not one company. By building support for that technology into Webkit, Apple is ensuring that mobile Web browsers will be able to access what we’ve come to know as the “full web.”


Webkit is used by Google, Palm, Nokia and RIM, so it has a pretty solid base.


One of the arguments often bantered about when the discussion of the “full Web” comes up is video. There is no doubt that Flash made huge strides over the years in having sites like YouTube encode their videos in Flash. But that’s for the desktop.


As Jobs points out, almost all of this video is also available in H.264 format (a format Flash also supports), so it’s viewable on the iPhone, iPad and iPod touch.


“Add to this video from Vimeo, Netflix, Facebook, ABC, CBS, CNN, MSNBC, Fox News, ESPN, NPR, Time, The New York Times, The Wall Street Journal, Sports Illustrated, People, National Geographic, and many, many others. iPhone, iPod and iPad users aren’t missing much video,” wrote Jobs.


You may ask why other companies adopted Flash for their mobile devices when Apple won’t. That’s easy, they are looking for something they have that Apple doesn’t. Considering how hard it is for tablet makers to compete with Apple, any perceived advantage will work.


I’m not an Adobe hater—I know quite a few people that work at Adobe and I think they’ve done some amazing things over the years. Flash for mobile devices isn’t one of them.


Chris Dawson said he gives “Apple a year until they cave [and adopt Flash]. Android tablets will just be too cool and too useful for both entertainment and enterprise applications if they don’t.”


I have been using my iPhone for years and my iPad for one year. I honestly can’t remember the last time I went to a Web site that wouldn’t load because I didn’t have Flash installed. I can load videos from YouTube and a host of other sites too, no problem.


Apple has sold more than 160 million iOS devices and there are no screaming, angry hordes of users breaking down the doors at 1 Infinite Loop demanding Flash on their devices.


In order for Apple to change its mind and adopt Flash, the technology has to be proven to be indispensable and that it will benefit its users. Apple has proven just the opposite is true.

But the question remains -- if women can be president, why can't they be citizens? Article 1 of the Universal Declaration of Human Rights declares, "All human beings are born free and equal in dignity and in rights." Yet it took another twenty years after its signing to get the international conventions on political and civil rights and on economic, social and cultural rights -- and, in the United States, another twenty plus years for Congress to adopt legislation ensuring women's political and economic rights. It took another thirteen years for the United Nations to ratify (without the support of the United States) the Convention to End All Forms of Discrimination against Women. And in 2011, the US House of Representatives and other foreign governing bodies still toy with legislation essential to women's identities, ranging from limiting access to reproductive health services and marriage to crafting sentencing guidelines that treat girls and women as felons and charges those that have abducted and abused them with misdemeanors.



In a 1946 column, written before she joined the UN Commission on Human Rights, Eleanor Roosevelt urged women to "call on the Governments of the world to encourage women everywhere to take a more conscious part in national and international affairs, and on women to come forward and share in the work of peace and reconstruction as they did in the war and resistance." More than fifty years later, at the dawn of a new century, the UN Security Council -- pressured by a well-organized international women's lobby, Hillary Clinton, and other stateswomen and embarrassed by the rampant use of rape and genital dismemberment as tools of war -- adopted Resolution 1325. It urged "Member States to ensure increased representation of women at all decision-making levels in national, regional and international institutions and mechanisms for the prevention, management, and resolution of conflict."



Now ten years later, the campaign -- indeed the struggle -- to enforce this resolution rages across the United States as much as it does across Egypt or the Congo or Afghanistan.



It is tempting to construct this resolution narrowly -- to see it as a tool of armistice rather than reconstruction, as a vehicle to protect women rather than empower them. To do so, to paraphrase Albus Dumbledore, would be to do what is easy rather than what is right.



UN1325 is on the front line in the campaign for women's citizenship. It is a battle to ensure that economic, social and cultural rights cannot be divorced from, or considered separately from, political and civil rights. It is the struggle to reclaim democracy promotion away from post-Cold War politics, self-interested development and the campaign against terror and place it at the heart of citizen participation.



Just as important, it is a campaign to ensure women's rights as citizens as much as it is a campaign to force governments to act responsibly to all its citizens. While equality and human dignity have no sex, policy designed without taking stock of gender differences often perpetuates discrimination.



As Eleanor Roosevelt would say, both citizens and governments must "recognize that the goal of full participation in the life and responsibilities of their countries and of the world community is a common objective" and one "which the women of the world should assist one another" in achieving.

The Road Out of Debt: Bankruptcy and Other Solutions to Your Financial Problems by Joan N. Feeney and Theodore W. Connolly


You've read stories of people becoming debt-free. In personal-finance blogs, the stories are always ones of debt problems overcome through hard work and frugality. Sadly, in the real world, that doesn't always work. For reasons like illness, divorce, job loss, economic downturn, business failure, natural disaster, war — some debts entered into in good faith simply cannot be paid back. Feeney and Connolly's new book is about how to find the dividing line between these cases, and what to do once you know which side you’re on.


Money-Management Skills


The authors provide a good short course in money management much like you’d find in any personal finance book or blog — how to budget, how to cut expenses, and how to take control of your finances. Then the book starts talking about debt — mainly about the many, many ways to use debt unwisely. In particular, they’ve got a great chapter on the sort of debt that people with financial troubles turn to in a usually futile effort to stave off financial catastrophe for one more month — payday loans, car title loans, pawn shops, loan sharks, etc.


Even before that, they provide some basic advice on negotiating with your creditors. Especially in the world of finance as it is today, there are plenty of people who could actually fulfill their obligations — except that the creditors have written rules that let them lard up a debtor’s obligations with late fees and penalty interest rates. A knowledgeable debtor with good negotiating skills can often cut through those problems and get their obligations settled reasonably cheaply.


One bit in that section that I particularly like is on the psychology of debt collectors: Some will browbeat you, some will humiliate you, some will pretend to be your friend — but however they act, they’re all just trying to get as much money from you as possible. They don’t care what other debts you have or whether you can support your family. If you don’t understand this — if you allow yourself to imagine that the ones who act like friends are actually friendly — you’re going to be less successful in your negotiations. (I talk about the same psychological issues in my post Don’t Treat Businesses Like People.)


The authors provide some useful advice on seeking help (credit counselors and the like) if your financial problems are beyond what you can manage with those basic skills — and about avoiding the scams that often masquerade as help for people with debt troubles.


Sometimes, even with help, debt problems cannot be overcome. Specifically, if you can’t cover your minimum expenses plus interest on your debts and have money left over to pay down the principle on your debts, then you're over the line. Once you're in that situation, your financial situation can only get worse — your debt burden will rise every month, even if you don't borrow any more money.


When to Consider Bankruptcy


If you could support yourself — pay for your family’s shelter, food, and clothing — except that other obligations drain away more than all the rest of your money, then it’s time to consider bankruptcy.


Even if it’s time to consider bankruptcy, it may not be the best choice. Some obligations (child support, student loans) cannot be wiped out in bankruptcy. Alternatively, if you can’t even afford the necessities, then your household is not a viable economic unit and bankruptcy won’t help.


The core of the book is the information you need to figure whether bankruptcy is worth considering — and the information to consider it and make an informed decision.



Your will should cover the disposition of your assets, name a guardian for your kids, name someone to manage property you leave to your kids, and name the executor of your estate. The executor is the person with the authority to see that your will is enforced.


In addition to a will, you may want to create a living will or advance medical directive. These are documents that let your doctors and caregivers know your wishes regarding medical care in the event of a major medical event where you may be unable to make your wishes known. To give your living will more power, you may also wish to assign medical power of attorney to your spouse or another loved one. Having someone acting on your behalf can help ensure that your wishes are followed.


You should consider creating a power of attorney for someone who can take over your financial affairs if you are alive but unable to manage them. You can assign someone either “durable power of attorney” or “springing power of attorney”. The former is automatically in place. The latter requires a court hearing to prove that you are not competent to handle your own affairs. A lawyer can help you decide which is right for you.


Finally, consider writing a “digital will“. This is a document that identifies all your online accounts at sites like Facebook, Flickr, and Myspace, and gives your family instructions about what you want done with them. It should include all relevant usernames and passwords. While not a legally binding document, this can be an invaluable tool for your loved ones to gain access to your social media accounts and manage them in the way you desire.


Organization

Once you’ve created these documents, you want to keep them organized in a simple, clear place where your family can easily access them should they need to. That could be in your file cabinet, with your attorney, in a safe deposit box. Wherever you do it, you should also make sure your heirs will have simple, organized access to your financial records and accounts, and any other important papers.


For most of us, these records aren’t just on paper anymore. Not only do I need to be sure my estate executor has access to my bank account numbers and 401K accounts; I probably want that person to be able to access those accounts online, too. They’ll need to get into my computer, and be able to access my Google documents and Mint account if they’re going to really make sense of my finances. You’ll want to include any necessary banking usernames and passwords with your important papers, along with your digital will.


Communication

When you’ve created your estate plan, tell your family about it. Be certain the person you picked to be guardian for your kids is willing to do it. Make sure your executor knows where you keep your will and other important papers. Let your heirs know what to expect from your will. All this will cut down on confusion and conflict after your death.


As you can see, doing all this requires having your financial and personal affairs in order. That effort will serve you well in your lifetime, as well as being a boon to your heirs when you’re gone.

Chinese authorities in the northwestern region of Xinjiang have ordered the executions of seven ethnic minority Uyghur men convicted of "violent" crimes, official media said on Wednesday.

 

The death sentences were handed down by the Supreme People's Court in recent days, according to state media in the regional capital, Urumqi.

 

The men were accused in connection with three separate attacks late last year in the Silk Road city of Kashgar, according to the news website Urumqi Online.

 

According to another website, the Xinjiang-based Tianshan news site, Aimaiti Tuheti, Yiming Dawuti, and unnamed "others" killed a security guard at a pedestrian mall as part of a failed Aug. 7 robbery attempt.

 

In a separate incident on Oct. 12, it said, Nuermaimaiti Aobulikasimu and 11 others broke into a house, bound and killed the couple living in it, and took their possessions.

 

It said the group also broke into the homes of two brothers, robbed them, and killed six people in a Nov. 11 attack in Kashgar.

 

The report gave no information about the victims or the schedule for the executions.

 

Three of the men were sentenced to death with a two-year reprieve, a sentence that is normally commuted to life imprisonment in China's judicial system.

 

They were convicted of deliberate homicide and armed robbery by the Kashgar Intermediate People's Court in the first instance.

 

'Strike hard' campaign

 

A Han Chinese resident of Urumqi surnamed Yang said a reference to "terrorism" in official news reports on the case showed that it was being politicized by the authorities, who have launched a series of "strike hard" campaigns in Xinjiang following deadly ethnic violence in July 2009.

 

"There is an implied political meaning; that they were somehow engaged in separatist activities or ethnic divisions," said Yang.

 

Exile Uyghur groups said the trials had been conducted behind closed doors, with scant opportunity for public scrutiny.

 

"The entire process against these men, from the trial through to the judgment, was opaque," said Dilxat Raxit, spokesman for the Munich-based World Uyghur Congress.

 

"There was also very little reasonable evidence to convict them on a legal basis, because all the evidence came from one side of the case," he said.

 

"We strongly condemn the Chinese government for continuing to pursue their policies of ethnic division," said Raxit.

However its road to success is approaching a giant pothole – otherwise known as its next labor agreement — and to me we’re entering a fascinating point in league history.


Forbes Magazine has reported that 12 of the 30 NBA teams lost money last season. And NBA Commissioner David Stern, several weeks back, claimed that league owners were projecting a cumulative loss this season of approximately 350 million dollars.


Stern has declared that the current labor situation is untenable because the players are being paid too much guaranteed money. The players for their part are digging in and this labor dispute shows few if any signs of getting resolved anytime soon.


There is also one glaring problem that I personally feel the NBA needs to fix because, if you ask me, it’s the one negative the league has faced for as long as Stern has been commissioner. Each season, too many teams have zero chance of making the playoffs.


Let’s face it, if you’re a fan of the Timberwolves, Wizards, Nets and a bunch of other teams, you’re basically watching games to see the opposing team because your team’s best chance to improve is to lose as many games as possible, get a high lottery draft pick and then have the ping pong balls fall the right way on lottery night. I think the whole rhythm of the filmmaking and the dialogue is different than what it would have been. It flows in a more emotional and staccato way. It’s interwoven and interlaced with a level of humor and emotional intensity that are based on the realism of the characters. Also the movie within a movie, the HBO documentary about Dicky, the Christian Bale character, is real and I seized upon that as a filmmaker and wanted to use that as a device in the film. Not only dramatically as a defining moment, which Scott Silver had focused on, but I wanted to also use it as a framing device throughout the film, that there was this documentary crew around and you could do interviews with the characters. So we did interviews with Mark and Christian as the characters on the fly and we did interviews with the sisters. We did interviews with local people who used to be mayor and town manager and real people about Dicky and Micky and their impact on the city, and that all got used in the movie as part of the story.


Music was also something that I really focused on, the style of music that these guys would listen to and the kind of soundtrack that would really propel through their story and that resulted in some of the great music that’s in the movie that I think is married well to the dramatic turns.


We actually had the opportunity to ask some of our listeners what questions they might have for you and Ben here asks, “I’d like to hear about the choice to use the song ‘Here Again I Go On My Own’. Was the scene where the two brothers sing along while walking to the ring based on reality or was it just the most incredible filmmaking choice of 2010? And if it was invented, who invented it? The power of that moment where these two guys find solidarity in this song before the big moment, combined with the fact that it is a song more associated with hair metal silliness more than emotion, made it probably my favorite scene of the year and I’d like to hear David O. Russell talk about it. Any thoughts about that particular choice?


That song, the Whitesnake song, was one Micky actually used as his entrance song for many of his fights. I always want to look for the most emotional and poignant thing, such as the moment when Alice sings in the car with Dicky and they sing that Bee Gees song, which to me that was a very powerful way to show their special bond. In this case, to show the bond between the two brothers, I thought it was very affecting to see them in the tunnel, to see their emotional bond before they went out to this big event and for Dicky to be singing the song with Micky and for them to be singing it together, so that was an idea I brought to the film.


You mention that song with Christian Bale and Melissa Leo. “Jag” asks about incest relationships in your films, [one being] Spanking the Monkey obviously. But also according to “Jag”, I don’t know if this is correct, that you have said before that Melissa Leo and Christian Bale’s relationship feels in some ways incestuous, especially in the scene where Bale is singing to her in the car. Can you comment on that or is that way off base?


No, that’s absolutely true. When I was first looking at the story, I immediately said there’s an incestuous relationship thing going on here and when I was selling myself as a director, I said I want to make more of the emotion of the relationship. This movie’s in my wheelhouse because I totally get those kind of family relationships having done Spanking the Monkey and Flirting With Disaster and I really think that sort of odd bond between Alice and Dicky should really be felt emotionally and almost romantically. When you look at their family albums, Alice, god bless her after having had nine kids, is still a beautiful woman who could look like she was as much her son’s girlfriend as much as she was his mom so that is true.


I promise this will be the last time I mention Darren Aronofsky’s name during this interview –


You can mention him as many times as you want because I was happy that Darren’s credit showed up on the film right before we went to final print. I said, “What that all about?” and they said he had the right to put his name on the film contractually and he saw the film and loved it and he wants his name on it so I take it as a compliment.


Right, because you mentioned in the EW interview that you were taken aback when he called to tell you about wanting to getting executive producer credit and I kind of wanted you to elaborate on that if you could.


Oh no he didn’t call me, I saw the credit on the final cut of the film and I said “What?” And yeah, I was taken aback. But then he was very sweet about it when I did see him. He embraced me and told me how much he loved the film and I’d heard he wanted his name on there because he loved the film and I think that’s a great compliment coming from a great filmmaker.


It’s been a number of years since your last film and we’ve heard about a bunch of projects that you’ve been attached to, for example Grackle with Matthew McConaughey and Nailed as well. For some reason these projects haven’t gone very smoothly. I’m wondering if you could talk a little about these projects and are there any sort of common factors that you can identify that cause problems, do you feel like you choose tricky projects or tricky ways of financing them?


Well, we need to be specific about what’s what because people, especially in the age of the Internet, just start chucking ideas around which are not based in fact and they pretty much just get picked up as fact. They’re all different. I wrote a couple of things after Huckabees that didn’t get made and that was my own responsibility because I decided not to make them. I was going through a period where I wasn’t feeling the material and a harder period for me as a filmmaker. It also resulted in me becoming a better filmmaker and a better writer and a more instinctive one. But there was a period there where I was questioning everything and Huckabees wasn’t entirely what I wanted it to be and I was going through a divorce so I can take responsibility for that.


Nailed was a project that any of the troubles with that had nothing to do with me. Those was about the company was financing it, and this was during the Madoff era, was inconsistent. I had never seen anything like it. Our financing got turned on and off like a faucet and we were shut down nine times during the production, having nothing to do with me, just having to do with the nature of the financing company. After that went on enough times I had to move on with my life, I have a family to support and I had to move on and write other things and make other films, you know? I spent almost two years trying to get that finished and I just said ok, I got to move on.


The Grackle was a picture that was written by the guys who wrote Bad Santa, [John] Requa and [Glenn] Ficarra, really funny, smart writers. They were the guys who also made I Love You Phillip Morris, great directors too. I thought that could be really funny. I was talking about making that and getting them to do a draft when my dear friend Mark Wahlberg came to me with The Fighter. So as much as I thought that was really a funny project, if I have to pick between someone who’s a little like a brother to me and that other project I’m going to have to go with The Fighter.


Those guys wrote me, Requa and Ficarra, and they said, “Gee, now you’re really sorry you didn’t make The Grackle aren’t you?” They meant it as a joke. [laughs]


[laughs] I think you made the right choice, actually.

Oh no need to apologize man, I’m happy to answer any of those questions, I just want to set them straight.


Right, right. Now last question about projects. This is from Rodrigo from The Playlist who’s asking these questions about Old St. Louis with Vince Vaughn.


Let’s talk about that. That was a really good project that I re-wrote for Vince kind of in the vein of Paper Moon. I thought I’d be making that this autumn but it’s really not up to me a lot of times. In that case a lot of it was up to Vince who decided to make the Ron Howard project instead, because we were supposed to making that, and he went off to make The Dilemma with Kevin James and that’s what happened with that. So, you know –


Yeah, sometimes things just don’t work out or don’t happen, I understand.


Well there’s still talk about making that project and we may still make it when the timing’s right. That happens all the time in this business.


I gotta ask you about Uncharted. Can you talk about your relationship with the property to begin with, had you played the games before you were approached with the project in the first place and just talk a little about that because it’s certainly one of my favorite games on the Playstation.

I wouldn’t describe it that way, but sure.


My good friend Chuck Roven who produced the Batman movies like The Dark Knight, and produced Three Kings with me, came to me with Avi Arad who used to run Marvel Comics and who does the Spider-Man movies, with Amy Pascal, the head of Sony, and said, “What do you think? Would you like to try to create a really smart, interesting, intense franchise based on this game?” And I said yeah, let me check it out.


My son plays most of the games in our house, and I will play them with him but I’m not hardcore. I’m not going to present myself as hardcore. But I played the game a bunch of times and I also read as much as I could about the game and I met the game’s creator, Amy Hennig, who’s really cool. I started to brew together what I thought could be a really cool idea that I’d never seen in a film before…Really intense action and really intense family dynamics on a global stage. To grow a game into a movie is an interesting proposition because a game is a very different experience than a movie. You guys are playing the game, and it’s about playing the game. It’s not about a narrative embracing you emotionally. You know what I’m saying? So, I want to create a world that is worthy of a really great film that people want to watch and rewatch, so that’s what I’m working on right now.


My last question is, I don’t know if you’ve read on the interwebs but a lot of people have made a number of suggestions as to how one should go about making an Uncharted game. I wonder if you have any reaction to that, or do you even know what I’m talking about to begin with?


Well I’ve had people come up to me after screenings and pitch people they think should play the roles and I think we’ve seen that before with movies like Interview with the Vampire where there was a lot of fans of Anne Rice’s book and there were a lot of strong opinions about how to make it.


As far as I’m concerned, I’m very respectful as far as the core content and sprit of the game, but beyond that it’s my job as a filmmaker to make what I think is going to be an amazing movie. People have to trust that and let that go, I think. There’s not a bunch of movies you can point to that are made from games that are amazing movies, that stand up to time as a franchise or as [individual films]. I personally think it’s really cool when you see that someone like Darren Aronofsky is going to make an X-Men movie or to get someone such as myself to make this picture. You can be guaranteed that it’s going to be real, it’s going to be raw, it’s going to be intense, it’s going to be original, and it’s going to be propulsive. And those are all the things that I want when I go to watch a movie like that.
