Making Money With Options

Paying for Android apps is easier for AT&T users as the operator is adding carrier billing for its Android device owners. Users who find an app they like in Android Market will have the option of having the software purchase tacked on to their monthly bill, rather than go through Google Checkout. The update brings a much needed payment alternative to Android Market and hopefully points the way to carrier billing support from all carriers soon.


Right now, a lot of people don’t buy apps from Android Market because they’re limited to Google Checkout. Besides being flaky for some users, Google Checkout requires new users to enter in their credit card information. It’s a step that turns people off and has been hurting paid downloads on Android Market compared to iTunes, where many users already have their credit card on file with Apple.


What people really want is to just add purchases to their carrier bill. A new Strategy Analytics survey found that 38 percent of consumers prefer carrier billing more than pre-registered accounts like iTunes and PayPal, which are tied for 31 percent. Credit or debit card entry is favored by 22 percent of users.


This is important for Android and its ecosystem of developers. Options like PayPal are also welcome but the easiest thing to do for a consumer is just tack it on to their bill. T-Mobile has previously supported this and Sprint announced last year that it would, though it hasn’t followed through. Verizon Wireless supports carrier billing for app downloads in its VCast App store but there’s no word when it will be come to Android Market. Google’s Eric Chu said Google will continue to partner with more carriers on carrier billing so hopefully we’ll see Sprint and Verizon at some point soon.


Overall, it’s another sign that Google is making significant efforts to address some of the problems in Android Market. Recently, Google overhauled the look of the Android Market, making it easier for people to browse content using more categories and additional tools such as finding related apps. For developers, Google has upped the size of apps to 50MB, reduced the refund window to 15 minutes and earlier this year, opened up sales overseas to more countries. There’s still more to be done. I’ve asked about that promised online Android Market storefront. But gradually, Google is getting the picture. Android developers need to be able to make money and giving them tools to do that will help the entire ecosystem flourish. Mobile ads and in-app purchases are important monetization pieces but paid downloads are key for many developers looking for a return on their work. Expanded carrier billing could be an essential piece in helping Android developers close the revenue gap on their iOS counterparts.

Counterfeiting is an arm’s race to nowhere. An endless struggle, with both sides trying to out-wit the other. While treasuries all around the world try to find new ways to make counterfeiters sweat, and ultimately unable to make fake money, the counterfeiters in the world just need to figure out how those individuals are making new money, and copy it. There have been plenty of options in the past, like watermarks, ink that never dries, holograms, and colors that can’t be copied. But, they’ve all been figured out in one way or another. But now, thanks to thin-film transistors, it may be almost impossible for counterfeiters to get the job done.




The new technology, which is still being fleshed out, is designed to literally wrap around paper money. The thin-film transistors are made out of gold, organic molecules, and aluminum oxide. The transistors are then set into a patterned mask, and laid on top of the money. How would merchants be able to tell if it’s the real deal? Once the film is in place, there would be about 100 different organic and invisible transistors on each side of the paper note. Thanks to a small 3 volt current, the note would seem to turn “on and off.”


So instead of having to use a special marker, a person would just pass the bill over a sensor, and if it manages to generate the required voltage, the bill is real, and they can buy whatever it is they intended on purchasing. There’s no doubt that this seems like a huge step to fight counterfeiting, but let’s face it: it’s necessary. Will it solve the problem? We can probably hope it does for a long time, but it’s probably not a permanent fix.

People Making Money Net


Inflation is running at a reported 5.1% in China, a figure most believe is on the low side. Nonetheless, China has been loath to hike rates out of fear of more "hot money" flowing in. Something had to give, and it did. The markets forced China's hand.

China raised interest rates for the second time since mid-October to counter the fastest inflation in more than two years and more moves may follow.

The benchmark one-year lending rate will rise by 25 basis points to 5.81 percent and the one-year deposit rate will climb by the same amount to 2.75 percent, effective today, the People’s Bank of China said in a one-sentence statement on its website late yesterday.

Premier Wen Jiabao is seeking to slow gains in property values and consumer prices that are making it harder for families to buy homes and pay for food. Bank lending and a wider-than-forecast November trade surplus have pumped more cash into an economy already awash with money.

China is tightening after a record expansion of credit to counter the effects of the world financial crisis. The broadest measure of money supply, M2, has surged by 55 percent over the past two years and outstanding yuan-denominated loans have climbed 60 percent to 47.4 trillion.

Residence-related costs, including charges for water, electricity and rent, jumped 5.8 percent last month from a year earlier, the most in more than two years, and consumer goods prices rose 5.9 percent, the biggest gain since August 2008, according to statistics bureau data.

Policy makers are concerned that raising interest rates could “encourage hot money inflows,” Paul Cavey, a Hong Kong- based economist at Macquarie Securities Ltd. said. “Raising interest rates has far more implications” than ordering lenders to set aside more of their deposits as reserves, as it may affect the ability of local governments and companies to pay their debts.

State Council researcher Ba Shusong told state television yesterday that the government will step up regulation of capital inflows, without specifying measures that will be taken.

The Ministry of Commerce is stepping up supervision of foreign investment in real estate to crack down on speculation after a 48 percent jump in overseas fund inflows to the industry in the first 11 months of the year, spokesman Yao Jian said on Dec. 15. Policy makers may also allow faster gains in the yuan to help curb inflation from higher prices of imported commodities, according to analysts’ forecasts.

China, everyone's favorite promised land, has a hard landing. China will grow at perhaps 5-6% but that is nowhere near as much as China wants, or the world expects. Tightening in China will crack its property bubble and more importantly pressure commodities. The longer China holds off in tightening, the harder the landing.
Capital Controls Coming

Initially, rate hikes will encourage more "hot money" inflows into China. In hopes of preventing those inflows, China has announced more capital controls. It will be interesting to see precisely what those controls will look like.

Currency Sterilization Needed

One thing China should do is sterilize speculative hot money and balance of trade inflows via domestic government bond issuance, hoping to curb money supply growth.

However, it is not as simple as that, because in a fractional-reserve credit system, a net increase in lending itself increases money supply.

Clearly the Chinese central bank is behind the curve. Will China simply restrict lending? Would it even work?

I do not know about the former, but the latter would eventually force a hard landing if China gets serious enough. Actually, there are so many problems that I think a hard landing is coming regardless, and the longer China dallies, the harder it will be.

In the meantime, these paltry rate hikes by China of .25 points each pale in comparison to increases in reported consumer price increases.

Enormous Property Bubbles Including Vacant Cities

It is not "consumer price inflation" that is the big problem. Asset inflation, especially property speculation is rampant.

Speculation will continue until China gets serious or until the pool of greater fools buying property at absurd prices dries up.

Exacerbating China's myriad of problems, an Army of Graduates Struggles for Jobs
In 1998, when Jiang Zemin, then the president, announced plans to bolster higher education, Chinese universities and colleges produced 830,000 graduates a year. Last May, that number was more than six million and rising.

It is a remarkable achievement, yet for a government fixated on stability such figures are also a cause for concern. The economy, despite its robust growth, does not generate enough good professional jobs to absorb the influx of highly educated young adults. And many of them bear the inflated expectations of their parents, who emptied their bank accounts to buy them the good life that a higher education is presumed to guarantee.

“College essentially provided them with nothing,” said Zhang Ming, a political scientist and vocal critic of China’s education system. “For many young graduates, it’s all about survival. If there was ever an economic crisis, they could be a source of instability.”

In a kind of cruel reversal, China’s old migrant class — uneducated villagers who flocked to factory towns to make goods for export — are now in high demand, with spot labor shortages and tighter government oversight driving up blue-collar wages.

But the supply of those trained in accounting, finance and computer programming now seems limitless, and their value has plunged. Between 2003 and 2009, the average starting salary for migrant laborers grew by nearly 80 percent; during the same period, starting pay for college graduates stayed the same, although their wages actually decreased if inflation is taken into account.

Chinese sociologists have come up with a new term for educated young people who move in search of work like Ms. Liu: the ant tribe. It is a reference to their immense numbers — at least 100,000 in Beijing alone — and to the fact that they often settle into crowded neighborhoods, toiling for wages that would give even low-paid factory workers pause.

“Like ants, they gather in colonies, sometimes underground in basements, and work long and hard,” said Zhou Xiaozheng, a sociology professor at Renmin University in Beijing.
Odds for social unrest will mount if China's growth slows. Yet, because of short-term overheating concerns on top of long-term peak oil issues there is no way China can keep growing at the current pace.

Eight Problems Facing China

  • Hot money inflows
  • Huge property bubble
  • Massive increases in money supply, much of it property speculation and building of unneeded capacity
  • Currency manipulation charges from the US and potential trade wars
  • Unsterilized trade imbalances fuel inflation
  • Slowing Europe
  • Dearth of Jobs for new graduates
  • Potential social unrest

Case For Hard Landing

Risks are enormously skewed to the downside, so much so that the odds China avoids a hard landing are not good. China is far more exposed to a slowdown in Europe than the US and the popping of China's property bubble will extract a huge toll.

Those plowing into commodities, foreign currencies, and equities (especially foreign equities), fail to consider those risks.

Moreover, given that much of China's growth is overheating and malinvestment, it is not even clear the Renminbi is undervalued.

The usual suspects always make the structural argument because they just don’t believe in fiscal policy and the normal means of stimulating investment and consumption. And I think it’s important to understand the fate to which that consigns 15 million unemployed Americans.


The unemployed are far more likely to go without health insurance, especially now that the COBRA subsidy has lapsed, making it harder for unemployed workers to maintain their old employer-based health coverage. Being uninsured puts people at far greater risk for unnecessary deaths. The unemployed have less money to spend on basic necessities. A new paper from the National Bureau of Economic Research shows that unemployed workers frequently cut back on healthy foods like fruits and vegetables, leading to poorer diets and, eventually, bigger health problems. Recent studies show a linkage between unemployment and suicide; during this past recession, calls to suicide hotlines have jumped along with the unemployment rate.


Not everything pulls in this direction; recessions correlate with fewer car accidents, presumably because there are less cars on the road at peak drive-time hours; and higher wages can result in greater consumption of cigarettes, which makes sense, as cigarettes have become taxed so heavily that they practically have become a luxury good. But in a general sense, the impoverished lifestyle is a more dangerous lifestyle. They call it the safety net for a reason, because with unemployment comes far less safety.


So the folks claiming that unemployment is structural and we just have to wait for the business cycle to turn around are essentially allowing millions of people to get sicker, more suicidal and in general more at risk. That’s inexcusable when something can be done to ameliorate the situation. Yet that’s where we are.

A very naughty nun must be dealing with some serious Catholic guilt today after she was charged with embezzling more than $1.2 million from a Westchester college. Sister Marie Thornton, 62, worked as vice president of finance at Iona College in New Rochelle, and is accused of stealing the money from the Catholic school over the last decade, by submitting false invoices and using a college-issued credit card for personal expenses.



Thornton was reportedly fired last year after the college discovered the financial discrepancies, but they didn't initially inform police or prosecutors; it's unclear what prompted prosecutors to charge her now. According to a former men's basketball coach at the school, Thonrton may have gambled away much of the ill-gotten dough: "I think she absconded with some funds or something down to Atlantic City," Jeff Ruland, who was fired in 2007, said on WFAN-AM in March. Thornton, who went back to being a full-time nun after she left the college, faces up to ten years in jail if convicted. As bad as Thornton's embezzling may have been, at least she wasn't trying to use her educators discount on sapphic vampire porn at a Borders Books and Music store while wearing her habit...because in all seriousness, we have seen that happen.

It is hard to not laugh out loud at the amazing stupidity of those who say "It's Different Here".

Please consider 'Low-doc' home borrowers hit by rising rates

A new report shows a sharp increase in the number of 'low-doc' borrowers struggling to keep up with their mortgage repayments as interest rates rise.

Adjusted for loans that passed from being in arrears to being settled because the property was sold, the percentage of prime loans more than 90 days in arrears increased from 1.33 per cent in the June quarter to 1.37 per cent in the three months to the end of September.

However, Fitch says self-employed borrowers have been hit hard, which has pushed arrears among prime low documentation loans to a record 3.97 per cent - slightly higher than the previous peak of mortgage delinquencies in this segment reached during the peak of the financial crisis in the December quarter of 2008.

The associate director in Fitch's structured finance team James Zanesi says higher mortgage repayments appear to be hitting the self-employed sector much harder than employees.

"The three consecutive cash rate hikes ending in May 2010 modestly affected Australian prime mortgage performance in the third quarter of 2010. Households have demonstrated some stability in spite of the higher mortgage payments," he said.

The very worst performance in the September quarter continued to be amongst the closest equivalent Australia has to subprime loans - 'low-doc, non-conforming' borrowers.

The arrears rate amongst this group was 18.94 per cent, although it makes up a relatively tiny proportion of Australian mortgages.
Progression of Rot

Australia is starting to get hit hard but the important word in this sentence is starting. Rot starts at the edges and the outside periphery (subprime and low-doc), then spreads to the core.

Delinquencies remain about 2.7 times historical average, foreclosure inventories are 7.4 times and rising.




October Month-End Data: Conclusions

  • Foreclosure inventories continue to grow, the rise in delinquencies remains subdued as a result.
  • Accelerated foreclosure activity has led to a rapid decline in agency delinquencies. Foreclosure inventories have risen dramatically as a result.
  • Most western states have experienced a decline in the total 30 day and foreclosure inventory over the last six months.
  • The issue of current loans going delinquent remains, however more and more sixty day defaults are repeats.
  • Modification dominated seriously delinquent cures have declined over the last several months but still remain elevated.
  • More six and 12 month delinquent loans are moving to foreclosure, but the extremely delinquent category continues to grow.
  • Foreclosure sales dropped sharply, down 35 percent nationwide. Impact was across all investor categories.
  • Origination activity continues to accelerate with the government percentage declining. High quality lending is yielding the best vintage performance in years.

The housing rot in OZ has just started and it's a long way to the core. But it will get there. Australia can look forward to similar stats in years to come.

If you thought robo signing was bad, you ain’t seen nothin’ yet.


The website 4ClosureFraud presents the gory details of a potential major new front in the foreclosure mess. A Pennsylvania foreclosure mill, Goldbeck McCafferty & McKeever, is accused by Patrick Loughren of allowing non-attorneys to file and prosecute foreclosures. A DailyFinance story gives the overview:


Two Pennsylvania cases, one state and one federal, have exposed new types of document problems in foreclosure cases. One of the cases has potentially transformative consequences for thousands of troubled Pennsylvania homeowners. At the center of each is the same law firm: Goldbeck McCafferty & McKeever (GMM)…


As long as a lawyer supervises foreclosure filings, and at least reads them before they’re submitted to the court, that is acceptable. But Loughren is suing because all three named partners of GMM, Joseph Goldbeck, Gary McCafferty and Michael McKeever, have admitted under oath — during depositions last September and in a separate case in December 2009 — that no attorney ever read the filings. The partners made clear that the practice has gone on for the past several years.


If Loughren prevails, this case will prove to be vastly more significant than robo-signing.


Robo signing, while a fraud on the court, does not necessarily invalidate the underlying legal action. Even a punitive judge is far more likely to take action against the lawyers involved in the robo signing or to reject the new corrected affidavits and require them to restart the foreclosure action afresh than dismiss the case with prejudice. Only if the affidavits or other documents were submitted in error would it inevitably disrupt the foreclosure, and in those cases, it OUGHT to present a problem to the party trying to foreclose.


The practice of law by non-lawyers is a far more serious matter. In Pennsylvania it is a crime. In the case against GMM and its apparently unsupervised paralegals, the plaintiff is seeking disgorgement of falsely billed “attorney’s fees”.


But even more important, the lack of attorney involvement would render the foreclosures void. Pennsylvania courts have found “proceedings commenced by persons unauthorized to practice law are a nullity”. Federal courts interpreting Pennsylvania law have supported this point of view.


If Loughren succeeds, the ramifications would be wideranging. For GMM foreclosures, it would cloud the title of the properties sold. The parties who lost their homes could seek recourse. It is unlikely they could reverse the foreclosures. As Bob Lawless noted at Credit Slips:


The law, however, strongly protects the finality of past foreclosure sales.


At first, these rules might seem unfair. Why should the law protect old court proceedings that have been tainted by mistake or, even worse, fraud? The answer, of course, is for the instrumental reason that a court system could not operate where every old judgment was open to attack. Losing parties will almost always feel the judge make a mistake or the opposing party misled the court through half-truths or outright lies. Before a court enters final judgment, procedural rules and court appeals are designed to maximize the possibility the truth will win out and to minimize the possibility of judicial error. The law imposes a very heavy burden on those seeking to attack final court judgments.


The same ideas strongly protect the finality of a court’s foreclosure judgment. The foreclosure judgment, however, is only an interim step to the ultimate disposition of the property at the foreclosure sale and the transfer of the deed. Now, third party rights will come into play, and the need for finality becomes even stronger. If foreclosure deeds were subject to attack, at worse we might have no bidders at the sale, and at best we would have drastically lower prices. Even if the successful purchaser at the foreclosure sale is the lender, it will be selling later to a third party, and we will have the same need for finality.


For these reasons, and not surprisingly, most every (or maybe even every–I’ll let someone else do the 50-state survey) state provides the strongest possible finality protections for deeds obtained through foreclosure sales.


But that does not mean the borrowers do not have other avenues. The logical targets are the foreclosure mills, and perhaps most important, the servicers and trustees. And per the lawsuit:


Plaintiff avers, on information and belief, that the “clients” of the non-lawyers – consisting of banks, loan servicers, REMIC trusts, and other creditors – are all aware that the non-lawyers are engaged in the unauthorized practice of law. The individuals employed at the entities (i.e., at the “clients”) all interact with the Non-Lawyer-Defendants on a day-to-day basis via e-mail and phone and they are aware that the Non-Lawyers are responsile for preparing, signing and filing these foreclosure cases and that the cases are being filed without attorney review.


Proving that the clients knew the paralegals were not supervised might be a stretch, but I suspect that the charge is accurate, particularly since as 4ClosureFraud points out, Bank of America was involved in a case where GMM staff admitted to the lack of attorney supervision and did nothing:


Loughren notes that in both cases involving the partners’ testimony about the practice, Bank of America (BAC) was the foreclosing bank. It was actually present during the December 2009 trial when the admissions were first made. Loughren points out that BofA’s representative at that trial, John Smith, is himself a lawyer, and so presumably understood the legal significance of GMM’s admission.


Other BofA employees surely learned about the practice too, given that the December case was an effort by the U.S. Bankruptcy Trustee to sanction both the bank and GMM for misconduct, and evidence submitted for it showed the involvement of “high-ranking” BofA people not normally involved in a foreclosure, such as its assistant general counsel.


So why is this such a big deal? Non-lawyers practicing law is impermissible in other states.


Most foreclosure mills are run on the same template: impossibly high staff to attorney ratios, 90 or 100 to every attorney. The ratios alone make meaningful supervision impossible. And this high leverage wasn’t due solely to partner greed. Some foreclosure mills, contrary to the laws of many states, had private equity funds as investors. And other foreclosure mills were keen to secure PE monies. So most industry incumbents had the same profile: an extraordinarily high staff to partner ratio, with standardized processes to maximize profits.


As a result, just as with the robo signers, it appears likely that documents were signed improperly. Matt Weidner has examples of signatures from an Ohio law firm by attorney Edward M. Kochalski that are so different that it is pretty implausible that one person signed them all. But here, the ramifications are far more serious.


The Loughren complaint looks solid and has detailed factual allegations.

So where have the state bar associations been? It’s appalling that there have been no sanctions or disbarments over the robo signing scandal. We need to see some lawyers lose their licenses, or better yet, their freedom. Otherwise, it will be clear that the legal profession is siding with its meal tickets rather than the rule of law.

Amid a shrinking home entertainment market, many in Hollywood have questioned whether any investment in a film library these days is a wise one. However, people close to Colony said the firm is convinced that Miramax was a largely ignored asset that will generate enough cash to repay the debt portion of the purchase within four years.

The library comes with about $300 million in revenue committed from existing deals, along with approximately $100 million in projected revenue for movies released in the last 10 years, people close to the acquisition said.

Under Lang, the new Miramax is expected to explore making a digital distribution deal with Google’s YouTube, building miramax.com as a destination site to view movies online, and launching a new cable channel devoted to its library, which includes titles such as "Shakespeare In Love" and "Chicago." The new owners will also seek a new distributor for Miramax's DVDs, a service that will continue to be handled by Disney for the next several months.

The new Miramax will have between 60 and 80 employees and about $15 million in annual overhead spending, said people with knowledge of the plans. Though executives will explore rights deals and partnerships for sequels and spinoffs based on its library, Miramax won’t finance the production of new films for at least a year, those people said.


A key figure in the Miramax negotiations was Nanula, a longtime senior executive at Disney who served as chief financial officer when the company acquired the specialty studio in 1993 from the Weinsteins.


When his boss, Barrack, gave him a green light to pursue entertainment acquisitions in late June, Nanula suggested they look at Miramax. Barrack contacted Tutor, who was already in talks with Disney to buy Miramax after a previous deal with Burkle and the Weinstein brothers collapsed.

As he had longstanding relationships with several Disney executives, including its lead negotiator, Executive Vice President of Corporate Strategy Kevin Mayer, Nanula spearheaded the talks beginning in early July. He and fellow Colony principal Justin Chang helped to shape the deal that Colony, Tutor and Disney agreed to in principle on July 23.

In the ensuing four months, many details of the purchase were reshaped, as investors originally brought in by Tutor, including Morgan Creek Productions Chief Executive James Robinson, were replaced by parties associated with Colony, most notably the Qatar fund.


Colony and Tutor plan to begin assembling their executive team in the coming weeks. Along with Lang, who has extensive experience in digital media, they are expected to hire a senior television distribution executive to sell Miramax movies to cable and broadcast networks around the world. At one point, talks were underway with Metro-Goldwyn-Mayer TV executive Jim Packer, but the two sides didn't reach an agreement.
